Terms of Service — CyberEOC

These Terms of Service ("Terms") govern use of CyberEOC at cybereoc.com ("Service") operated by CyberEOC. By creating an account or using the Service, your organization agrees to these Terms.

Service description

CyberEOC is a subscription-based emergency operations platform. Organizations use it to manage geo-coded assets, layer live intelligence feeds, log operational events, and share situational awareness with authorized operators and team contacts.

Accounts & eligibility

Accounts are created for organizations, not individual consumers. Administrators are responsible for who receives operator access.
You must provide accurate registration information and keep credentials secure.
You are responsible for activity under your organization's account.

Subscriptions & billing

Paid plans, add-ons (including SMS, map icons, and location packs), and trial terms are described at signup and in your billing dashboard. Fees are billed as stated for your selected plan. Unless required by law, fees are non-refundable except as we expressly agree in writing.

Acceptable use

You agree not to:

Use the Service for unlawful, harassing, or fraudulent purposes.
Send unsolicited marketing or spam through email, SMS, or share links.
Attempt to breach security, scrape, or reverse engineer the platform.
Misrepresent the source or urgency of alerts in a way that could cause harm.

Operational alerts should reflect genuine incident or safety-related communications for your organization.

SMS & MMS terms

If your organization enables the SMS add-on, CyberEOC may deliver text messages on your behalf to team contacts you enroll in the dashboard.

Your responsibility:You must obtain each recipient's consent before adding a mobile number and before sending operational SMS/MMS.
Message types: Operator-initiated incident updates (map links, optional map images) and, when enabled, automated NWS weather alerts for monitored locations.
No marketing: SMS through CyberEOC is for operational and safety communications only, not promotions or lead generation.
Frequency: Varies by incident and alert activity; many contacts receive no messages until an event occurs.
Opt-out: Recipients may reply STOP to end SMS from CyberEOC for that number. Reply HELP for help. Message and data rates may apply.
Limits: SMS add-on includes a monthly message allowance; overage rates apply as stated in billing. Delivery depends on carriers and recipient devices; we do not guarantee delivery of every message or MMS.

Data & intelligence feeds

Intelligence layers (weather, hazards, declarations, etc.) are sourced from third-party providers including U.S. government feeds. Data is provided "as available" for situational awareness — not as a sole basis for life-safety decisions. You remain responsible for verifying critical information through official channels.

Intellectual property

CyberEOC, its software, branding, and documentation are our property or our licensors. Your organization retains ownership of data you enter (assets, contacts, events). You grant us a limited license to host and process that data to provide the Service.

Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBEREOC AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS PAID BY YOUR ORGANIZATION TO CYBEREOC IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

Termination

You may cancel per billing settings. We may suspend or terminate access for violation of these Terms, non-payment, or abuse. Upon termination, your right to use the Service ends; export or retrieval of data may be subject to your plan and our data retention practices.

Changes

We may update these Terms. Continued use after the updated date constitutes acceptance of the revised Terms. Material changes will be posted on this page.
